I am not an attorney, I am a judgment referral expert (Judgment Broker). Nothing in any of my articles should ever be considered legal advice.
Most judgment recovery specialist know that succeeding in the judgment recovery business depends on what you know, what you study, how hard you work, how long you have been in business, how well you screen judgment cases, and how well-funded you are.
This article covers improving judgment business efficiency, and ways to spend more time on productive activities, and less time standing in lines, driving, and getting frustrated.
One of the largest frustrations is when Original Judgment Creditors (OJCs) waste your time, and then don't return your paperwork. Some call you and explain to you their life's story, and what a SOB the judgment debtor was, and then repeat themselves for 45 minutes, and then do not return the paperwork you sent them.
One solution is to start using a mobile notary in your business. When you hire a mobile notary to go to all the local OJCs, you can often get a reasonable price for each notarization. The mobile notary delivers your papers, notarizes assignments, and mails or returns the papers back to you. This makes it easier for the OJCs, and helps to weed out the flakes.
If an OJC does not want a visit (at their choice of location and time) by a mobile notary, they may not be worth investing more time with. Better to mention your mobile notary service early in your discussions with the OJCs, to keep them from wasting your time.
Mobile notaries only serve a limited geographic area, which should not be a problem, as another way to stay efficient, is to only recover judgments local to the court and you. The days of remote-control judgment enforcement are almost gone. One solution is to work with more than one mobile notary, another is refer judgments not close to you to a judgment broker or another judgment recovery professional.
Another way to improve efficiency is to use an attorney service. Attorney services are not too expensive, and one does not have to be an attorney to use one. An attorney service visits your office or home each business day. They take your papers to the court, and pick them up when the court is done, and return them to you. Some also visit process servers. Skipping trips and parking costs at the process server and court, saves you some money and considerable time too. Another way to boost efficiency is to begin digitizing documents, and save them in folders on your (regularly backed up) computer. One easy way to digitize documents is to use an online fax service that e-mails you faxes as PDFs. You can fax your number, and save all attachments as PDFs and then store them on your computer. This means less time doing filing and less filing cabinets.
Consider using a Macintosh computer if possible, or at least use a Mac when you can, because they are easier to back up and less trouble. Use free public record searches, for example Google or Bing, before using paid searches.
Another way to improve efficiency, is to move toward not permitting time leaches and flakes to suck up your time. When someone asks you, what is your phone number after calling you, or if they e-mail you, asking for your e-mail address, it is best to keep communications short with people like that. If an OJC calls you more than once, keep the topic centered on "please send me a copy of your judgment".
When you schedule debtor exams, which are needed more now than ever, schedule them to conserve your time. Schedule examinations at the same court at the same time. It is better to schedule 4 debtor exams simultaneously, so the judgment debtors must wait longer, and you go to the court once, instead of four times.
Do not save every e-mail you get. Many pro shoppers will e-mail one hundred judgment enforcers per day for a week. Whenever someone e-mails you about a judgment, and you see the message was also sent to undisclosed recipients, consider deleting it. Such messages often result in a bidding war for a crummy judgment.
Finally, many posts on judgment-related e-mail lists and forums are not worth keeping, and some the brightest stars are too wordy. One solution is to have a folder on your computer with word or text files on each topic. When you find a useful post or email, copy and paste it into a specifically named document. Edit out the fluff, and save only the useful parts, then save the file, and delete the original email.
